Terms of Service

The rules that apply when you use Questiva Consultants.

1. Acceptance

By creating an account or using any part of Questiva Consultants (the “Service”), you agree to these Terms. If you don’t agree, please don’t use the Service.

2. Your account

You are responsible for keeping your login credentials private, and for everything done through your account. You must provide accurate information when you sign up. Questiva is built for college, vocational, and professional learners; you must be at least 13 years old to hold an account, and instructors running a class that includes learners under 13 must contact us first so we can put the right agreement in place.

3. License

We grant you a personal, non-exclusive, non-transferable license to use the Service for your own learning or teaching, subject to these Terms. You may not resell, sublicense, or redistribute our textbook content, assessment items, or course materials without written permission.

4. Acceptable use

  • Don’t scrape, mirror, or systematically download our content.
  • Don’t share your account or transfer access to another person.
  • Don’t attempt to bypass paywalls or access controls.
  • Don’t use Questiva for anything illegal or to harm others.

5. Payments and refunds

Prices and our refund window are listed on the Pricing page. Payments are processed by our payment processor, currently Authorize.net. We are not responsible for fees your bank or card issuer may charge.

Yearly access is a one-time payment for one year of access and does not renew automatically. The year starts the day you begin reading. When it ends, you may renew for another year or switch to monthly access. Monthly access renews automatically until you cancel from your account. Before you pay, we show the price, renewal interval, and cancellation terms, and we send those same details in your confirmation.

Where we agree to invoice an institution on payment terms, payment is due by the date shown on the invoice. Access and shipment are released once payment clears unless we have agreed otherwise in writing.

Sales tax is added where required. If you are tax exempt, give us your exemption details before you buy so we can apply them. We cannot retroactively refund tax that has already been remitted to a state.

6. Your content

You retain ownership of anything you submit (assessment answers, tool inputs, classroom invites). You grant us a limited license to host and display that content as needed to run the Service. We may use aggregated, anonymized usage data to improve the platform.

7. Termination

You can close your account at any time. We may suspend or terminate your access if you violate these Terms. Where possible, we’ll give you notice before doing so.

8. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any content is complete or current.

We strive to make our educational content accurate, but Questiva is not a substitute for professional accounting, tax, or legal advice, and passing any assessment here is not a guarantee of passing a certification exam. QuickBooks is a product of Intuit Inc.; we are not affiliated with, endorsed by, or sponsored by Intuit, and Intuit may change its software at any time in ways our materials have not caught up with.

Our AI tutor and support chat can be wrong. Treat their answers as a starting point, check them against the textbook, and independently verify the source records before acting on anything in real books.

9. Indemnification

You agree to indemnify and hold harmless Questiva Consultants and its personnel from any claim, loss, or expense (including reasonable legal fees) arising out of your misuse of the Service, your breach of these Terms, or your infringement of someone else’s rights. We will tell you promptly about any such claim and let you take over its defence where the law allows.

10. Limitation of liability

To the maximum extent permitted by law, Questiva Consultants is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limits above apply only to the extent the law allows, and nothing in these Terms limits liability for fraud or for anything else that cannot lawfully be limited.

11. Copyright complaints

We respect copyright and expect our users to do the same. If you believe material on Questiva infringes your copyright, send a notice to [email protected] identifying the work, where the material is on our site, your contact details, and a statement that you believe in good faith the use is not authorised. We remove infringing material and terminate the accounts of repeat infringers.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in California, and you and we each consent to that jurisdiction.

Before filing anything, please email us, nearly every problem we have seen was faster to fix directly. Nothing here prevents either of us from seeking relief in a small-claims court.

13. Changes

We may update these Terms as the product evolves. Material changes will be announced to active account holders before they take effect. Continued use after the effective date means you accept the new Terms.
